Cheery Mount Consulting Hong Kong Limited (“we” or “us” or “our”) respects the privacy of our clients and candidates. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website www.cheerymount.com and our mobile application, including any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Site”). Please read this Privacy Policy carefully.  If you do not agree with the terms of this Privacy Policy, please do not access the site.

COLLECTION OF YOUR INFORMATION

We collect Personal Data of our employees, clients, candidates, suppliers, business partners, shareholders and website users.  We may ask you to provide us with certain personally identifiable information on the Site, such as your name, email address, postal address, telephone number, Hong Kong residence status, and demographic information, such as your age, gender, place of residence and interests, that you voluntarily give to us when you 

 

  1. register or subscribe to our services or request further services on any of our Site;
  2. contact us to report a problem with our Site or make any enquiry or comment; and
  3. apply for a job online or work with us, you may require providing (without limitation) data about your education, qualifications, skills, and employment history, etc. Your application will comprise your consent to our use of this data to access your application and to allow us to conduct any reference checking and other related activities as may be required of us under applicable law as an employer.

 

 

DISCLOSURE OF YOUR INFORMATION

We own the information, data collected during business operations, registration, subscription of our products and services, interviewing, screening process, HR outsourcing process and payroll outsourcing process.  We will not use or disclose your personal data for any other purpose without first seeking your consent, unless authorised or required by law.  Generally, we will only hold, use, disclose and otherwise process your personal data for the following purposes:

 

  • to provide the delivery of our products and services to you;
  • to maintain our business relationship, where you are a user of our Site, a client or a candidate;
  • to provide the recruitment services to our clients on their staffing needs and our candidates for the career development needs;
  • to provide the HR Outsourcing Services and Payroll Outsourcing Services for their HR Operations needs;
  • to enable the candidates to submit their resumes to us for job applications and your resumes and personal data will be viewable and searchable internally and may be forwarded, transmitted, or ported to our recruitment team;
  • to match your qualification, experience and skills with job vacancies, to assist us in finding a position that is most suitable for the candidates and, where you have provided your prior consent as a candidate, to send your personal data to clients in order to proceed the job application for you;
  • to enable the ongoing discussions and communications with candidates including answer enquiries and update the recruitment progress regarding to the potential job opportunities as the recruitment needs of clients
  • to provide clients with data about the candidates during an assignment or placement of short-term and permanent employment, including qualifications, licenses, reference checks (including sensitive data checks, where you have consented), migration status and other personal data you have provided to us;
  • to market and promote products and services to you, advise you of news, information and industry updates, events, promotions and competitions, reports and other data via direct marketing telephone calls, email, direct mailings etc.   We will enquire your preference on marketing analysis, nature of services and/or products before we provide you with the direct marketing promotion materials;
  • to trust the third parties such as suppliers, business partners etc. where we have retained them to provide products or services that you have requested, such as psychometric evaluations or skills tests, and to third parties who provide services to us.  These third parties must comply with similar undertakings of privacy and confidentiality as us;
  • to comply with any legal, regulatory or statutory requirements relating to our provision of products and services and to make disclosure under the requirements of any applicable law, legislation, rule, ruling, regulation, direction, court order, by-law, guideline, circular or code (collectively “laws”) applicable to us;

All information is provided by you on a voluntary basis.  We reserve the right to verify information provided voluntarily by clients and candidates. Such verification may include, but is not limited to, the checking of academic qualifications with issuing authorities, the confirmation of previous employment records including salary details and the contacting of designated referees.

We will retain candidates’ personal data in our database to assist our candidates for their long-term career development. We maintain specific records management and retention policies and procedures to delete personal data after a reasonable period of time in accordance with the following retention standards:

 

  1. we will retain your data as long as we maintain an ongoing relationship with you (in particular if you have an account with us)
  2. we will retain your data for as long as your account is active or required to provide you with services
  3. we retain your data for as long as needed to comply with the legal and contractual obligations. 

 

If we no longer need your personal data and we are not required by law to keep it, we will take reasonable measures to destroy or permanently de-identify the Personal Data.

  • Has the right to verify our policies and practices related to personal data and the right to know the types of personal data we hold.
